1. Agreement
By using smpofflorida.com, requesting or booking a service, or receiving services from Speedy Mobile Phlebotomy LLC, you agree to these Terms. If you do not agree, do not use our services.
2. Nature of our services
Speedy provides specimen collection, processing and delivery; therapeutic phlebotomy; administration of prescribed injections; and administration of provider-ordered IVs. We do not diagnose, prescribe, interpret results or provide medical advice. Information on this website, including the knowledge base, is general education and not a substitute for advice from your healthcare provider. In an emergency, call 911.
3. Orders and prescriptions required
Services require a valid order or prescription from a licensed provider, or a valid requisition from a direct-to-consumer laboratory. You are responsible for the accuracy of orders and for medication you provide. We may decline or stop any service we believe is unsafe, unlawful or not supported by a valid order.
4. Your responsibilities
You agree to provide accurate information; follow preparation instructions from your provider; provide a safe, lit and accessible location; secure pets; and disclose relevant conditions such as fainting history, bleeding disorders, blood thinners, allergies or access restrictions on a limb.
5. Minors and consent
A parent or legal guardian must be present and consent for patients under 18. You consent to the services you request and acknowledge known risks, including pain, bruising, hematoma, lightheadedness, fainting, infection, nerve irritation and the need for repeat collection.
6. Booking, scheduling and requests
A website request is not a confirmed appointment until we confirm it. Arrival windows are estimates and may be affected by traffic, weather and other patients. After-hours collection may be available depending on technician availability and specimen stability, for an additional fee.
7. Fees, payment and cancellations
Our visit fees are separate from laboratory testing charges. Laboratories bill you or your insurer for testing; Speedy collects insurance details only to provide to the laboratory and does not bill your insurer for its visit fee. Fees are due as quoted at booking. Cancellations or reschedules with less than 24 hours’ notice, or a missed visit, may incur a fee stated at booking. Refunds are at our discretion except where required by law.
8. Laboratories and third parties
Laboratories, couriers, shipping carriers and ordering providers are independent of Speedy. We are not responsible for testing, results, turnaround times, billing or acts of those third parties, including specimen loss or delay after the specimen leaves our custody. If a specimen is rejected due to our error, our sole obligation is to recollect at no additional visit fee.
9. Disclaimer of warranties
Except as stated in these Terms, services and the website are provided "as is" without warranties of any kind, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Speedy and its owners, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim arising from our services or website is limited to the fees you paid for the service giving rise to the claim. Nothing limits liability that cannot be limited under Florida law.
11. Indemnity
You agree to indemnify Speedy against claims arising from inaccurate information you provide, invalid orders, medication you supply, or your breach of these Terms.
12. Website use
Do not misuse the website, submit false requests, attempt unauthorized access or copy our content. We may suspend access for misuse.
13. Governing law and disputes
These Terms are governed by the laws of the State of Florida. Before filing any claim, you agree to contact us to try to resolve it informally for 30 days. Any action shall be brought in the state or federal courts located in Broward County, Florida, and each party waives a jury trial to the extent permitted by law.
